Court Upholds Verdict in Zamora v. Nationstar Case


Earlier this year, the Eastern District Court upheld an important verdict in the Zamora v. Nationstar case.  This is one of several cases where Clay Gatens, partner at JDSA, represents a class of borrowers who were locked out of their homes by their loan servicer, after the borrowers defaulted on their loans, and prior to the completion of a foreclosure. 

The Federal Housing Financing Agency was allowed to intervene in the case, and sought to have the case dismissed in part based upon a federal preemption argument arguing that federal law preempted Washington State law. 

The judge ruled in favor JDSA's clients, finding that there was no preemption and held that Washington law governs.  “This is an important win for Washington borrowers as well as JDSA”, stated Gatens.
